ABOR IP Policy

It is important for SI’s outside counsel to know, at a high-level, the Arizona Board of Regents (ABOR) IP policy that governs ASU IP. Knowing the policy at a high-level helps SI by enabling outside counsel to spot and flag issues for SI that arise during the ordinary course of prosecuting SI’s cases (e.g., inventors asking to assign directly to their own startups, which would violate the ABOR IP policy). The ABOR IP policy, called “ABOR 6-908,” can be viewed here: ABOR 6-908 Intellectual Property Policy.

Outside counsel is not responsible for proactively conducting substantive ASU IP analyses and should not do so. However, counsel should flag issues for SI to analyze and handle internally and/or request assistance from outside counsel on a case-by-case basis (e.g., conducting an independent inventorship analysis). Communications
